Verboten gem. § 29 BtmG ist Anbau, Herstellung, Handel treiben, Ein-, Aus-, Durchfuhr, Abgabe, Veräußern, place on the market, acquiring, holding, obtaining, advertising, provision of money, prescribing, administering and procuring / Grant / sharing of opportunities. Auch im GÜG (§19) sind dafür eigene Strafvorschriften enthalten.

Kategorie 1 erfasst direkte Vorläuferstoffe, häufig missbräuchlich verwendeter Betäubungsmittel. Handel, Ein-, Ausfuhr und Herstellung dieser Stoffe sind genehmigungs- und meldepflichtig. Selbst Apotheken müssen für diese Stoffe eine Endverbleibserklärung unterzeichnen. Ein Verstoß ist strafbar. Zum Beispiel Ephedrin der Vorläufer von Methamphetamin und Lysergsäure der Vorläufer von LSD. Aktuell sindin dieser Kategorie 13 Stoffe erfasst.

Kategorie 2 erfasst Reagenzien, die für die unerlaubte Herstellung von Betäubungsmitteln verwendbar sind. Herstellung, Ein-, Ausfuhr und Handel sind registrierungspflichtig, allerdings erst bei Überschreitung eines Grenzwertes. Handelt es sich um geringere Mengen, fallen diese Stoffe nicht unter das GÜG. Somit dürfen diese Dinge nur in Apotheken und nicht in Headshops verkauft werden. Wer das Zeug nur konsumiert oder in Eigenverbrauchsmengen mitführt, kriegt keinen Ärger mit dem AMG. Wohl aber wer es vertickt.
